1. Acceptance
By using summitprivatecredit.com or submitting an inquiry, you agree to these Terms. If you do not agree, do not use the site.
2. Nature of Services
Summit Private Credit is a commercial finance broker. We are not a bank, depository institution, registered investment adviser, or licensed mortgage lender. We arrange financing between principals of business entities and third-party institutional lenders. All credit decisions, advances, fees, covenants, and final terms are at the sole discretion of the lender. Nothing on this site is an offer, solicitation, or commitment to lend.
3. Eligibility
The site is directed at principals of U.S. business entities and accredited counterparties. It is not intended for consumers, retail investors, or anyone under 18.
4. Accuracy of Information
You represent that all information you submit is true, accurate, and complete. Misrepresentation may result in declined files, withdrawn offers, and reporting to lenders or regulators.
5. Compensation
We are typically compensated by the lender at closing through commission or origination splits. In certain transactions, an advisory fee may be paid by the borrower and will be disclosed in writing prior to funding.
6. No Guarantee
Rates, advance rates, term, and structural figures shown anywhere on this site are indicative and non-binding. Past placements are not a guarantee of future results.
7. Communications & TCPA Consent
By submitting an inquiry or providing your phone number, you consent to receive calls, SMS, and email from Summit Private Credit and its lender partners about your inquiry — including via autodialer or prerecorded message. Consent is not a condition of any transaction. Reply STOP to opt out of SMS. Standard message and data rates apply.
8. Intellectual Property
All content, marks, and software on this site are owned by Summit Private Credit or its licensors. You may not copy, modify, or redistribute without written permission.
9. Disclaimer of Warranties
The site is provided "as is" without warranties of any kind, express or implied, to the maximum extent permitted by law.
10. Limitation of Liability
To the maximum extent permitted by law, Summit Private Credit will not be liable for indirect, incidental, consequential, special, or punitive damages arising from use of this site or our services. Aggregate liability is limited to fees actually paid by you to us in the 12 months preceding the claim.
11. Indemnification
You agree to indemnify Summit Private Credit against claims arising from your misuse of the site, breach of these Terms, or violation of law.
12. Governing Law
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Exclusive venue is the state and federal courts located in New York County, NY.
13. Changes
We may update these Terms at any time. Continued use after posting constitutes acceptance.
